Section 15A: Overriding effect.
The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force.
Explained:
Section 15A of the Telangana Gaming Act, 1974 provides an overriding effect to the provisions of the Act. It was inserted through the Telangana Gaming (Amendment) Act, 2017, as part of the legislative changes that strengthened the regulation of gaming, wagering, betting and online gaming in Telangana.
The main purpose of Section 15A is to ensure that where there is any inconsistency between the Telangana Gaming Act and another law in force, the provisions of the Gaming Act will prevail to the extent of that inconsistency. The provision therefore operates as a non-obstante clause.
This provision is particularly significant because the 2017 amendments expanded the statutory framework to cover online gaming, cyber space, electronic records, digital transactions and wagering or betting, thereby adapting the legislation to modern forms of gaming.
